The city of Mankato's liquor ordinance is vague, according to one of the arguments made by attorney Jim Fleming at an appeals hearing for the bar Boomtown Friday afternoon.
Boomtown is appealing a four day liquor license suspension that is scheduled to start October 31.
Fleming also presented a letter from the city to Boomtown saying a strike wouldn’t be counted, but a spokesperson for the city admitted the letter contained a mistake regarding the strike.
City attorney Eileen Wells delclined to comment, but in testimony she says two drinks and a token violate the city ordinance. Fleming argued that the token is a piece of plastic so giving a patron two beers and a token is not a violation as the law is written.
The hearing officer's decision is expected today or Tuesday.
