Football coach Todd Christian Hoffner was formally charged with two felony counts involving pornographic materials Wednesday afternoon. 

Both charges involve videos found on Hoffner’s work cell phone, and police say involve Hoffner’s three children.   

Count I Use of Minors in Sexual Performance/Pornographic Work carries a maximum sentence of ten years and/or $20,000 fine.

Count II Posess Pornographic Work - Computer Disk/Electronic/Magnetic/Optical Image with Pornography carries a maximum sentence of five years and/or $5000 fine. 

Hoffner's attorney, James Fleming spoke for his client in court, defending the videos as innocent family videos.

The videos were discovered by IT staff at Minnesota State University Mankato where Todd Hoffman has been the football coach for five years.  Hoffner reportedly paid $40,000 bail.  Hoffner will be allowed to have supervised contact with his children. 

Please note the sensitive nature of the following information, which was taken from the Statement of Probable Cause filed 8/22/2012:

On August 16, 2012, the Mankato Department of Public Safety was provided, by a representative of the Minnesota State University-Mankato, a compact disc containing three videos.  The representative stated that the videos were taken from the phone of an MSU employee identified as Todd Christian Hoffner during a data transfer.

As Hoffner lives in Eagle Lake, Mankato police turned the investigation  over to Blue Earth County Sheriff's office on August 20.  Investigators viewed the three videos.

In one video, which lasts about a minute, three young children, ages five, eight, and nine are seen.  An adult male voice is heard several times on the audio.  The children, one boy and two girls, address the adult male as "dad."  The boy fondles himself several times in view of the camera and the other children turn their backs to the camera and spread their buttocks, exposing private body parts.

In another video, lasting about ten seconds, the two girls are naked and dancing when the boy joins the girls wearing a football helmet but no other clothing.

A third video, approximately two minutes in length, shows a child sleeping.  A hand appears pulling black the blanket and a male voice wakes the girl and tells her to go potty.  The camera then follows the child with the camera on the child's buttocks which are covered with flowered underwear.  The video follows the child into the bathroom, then ends.

Police say they have determined that the children in the videos are the children of Hoffner.
