The New House Republican Caucus has filed a lawsuit against Governor Walz regarding the use of executive orders during a peacetime emergency. State Representative Jeremy Munson of Lake Crystal says the Governor has violated the state constitution in three ways.
“The executive orders are an exercise of pure legislative power with no legislative oversight,” said Munson. “Secondly, state law says the Governor does not have the authority to declare a peacetime emergency for a public health crisis. And thirdly, it allows the Governor to declare a peacetime emergency and requires the legislature to veto that order.”
Munson says legislative vetoes are not allowed under the Minnesota constitution and the US Supreme Court has ruled legislative vetoes unconstitutional. The lawsuit was filed in Ramsey County District Court.
