Governor Tim Walz’s emergency COVID orders are facing what’s believed to be their first legal challenge — a group called Free Minnesota Coalition asking the state Appeals Court to nullify provisions that are keeping small businesses closed. Spokesman Dan McGrath:

“This is where the governor has overstepped his authority, is that he’s arbitrarily picking winners and losers — and it’s the small mom-and-pop shops that are the backbone of our economy that are suffering.”

State Employment and Economic Development Commissioner Steve Grove wouldn’t comment directly on the lawsuit, but did say the administration “gets it”

…”why a small business on Main Street isn’t open and they look down the street, at the end of the street, and a larger big-box store is. That’s challenging…. We’ve got to continue to look at these issues very closely, look… for ways that we can start to open up in a thoughtful way.”
