How do the courts decide what charges to file against criminal suspects? Blue Earth County Attorney Pat McDermott says its part of the criminal justice process.

“Law enforcement has to determine reasonable and probable cause,” said McDermott. “Our job is to determine what can be proved beyond a reasonable doubt. Just because we can charge someone doesn’t mean it can be proven beyond a reasonable doubt.”

McDermott says the state felony sentencing guidelines binds his office to make sure someone in Duluth doesn’t get a harsher sentence than someone in Mankato.
